Like the case in Sunnyvale - an environmentalist planted evergreen trees ten years ago. His environmentalist neighbor is suing him because his trees are blocking the sun from the neighbor's solar panels. The environmentalist neighbor wants the trees topped to 15 feet or totally cut down.
This law would create that havoc up here.

This is the need for the additional statute:
Right now, pets are considered just property, like a garden gnome or a windowpane, and any cause of action would be limited to damages equalling the replacement cost of the "property".
The bill under consideration would allow for additional damages for pain and suffering both of the pet animal and of their family in certain circumstances.
I don't see this as stupid at all. While an animal's life should not merit the same kind of damages as a human being's (a human is worth on average about 2 million in wrongful death cases curently), it still seems that if the neighborhood unemployed drunken slugabout comes over and beats your new puppy to a bloody, gruesome death in your driveway in front of your five year old (who will now likely have nightmares for a good decade), that being able to recover a few thousand dollars (or slapping a lien on everything he owns) for the pain and suffering the puppy and your child endured should not be out of the realm of reasonable claims.
This bill elevates pets to somewhere above regular inanimate property, which pets ARE, while still not equating animal life with human life.
It's a fair bill, and I'm surprised at EFF for including it in the list of otherwise silly bills.
