I have a couple of radio appearances this morning:
* Kirby Wilbur, KVI 570 at 8:45
* Dave Ross, KIRO 710 in the 9:00 hour, following Dean Logan

1. I thought Dave Ross was biased against you, beyond merely being a "devil's advocate", which would otherwise be fine. At one point he said something like that Maleng's not prosecuting anyone was because he "apparently" (or did he say "obviously"?) didn't think the cases had merit. You had just responded to that question by saying it appeared to be a matter of priorities. That was a good and sensible answer. It seemed to me that Ross made an unsupported leap of logic to say that Maleng wasn't pursuing the cases because they lacked merit. All we know is Maleng isn't prosecuting. You offered some support for your opinion - conversations you'd had with insiders. Ross offered nothing to support his opinion that, effectively, marginalized what you had just said.
I am so disappointed in the "crusader for common sense" - he frequently shows nothing but disdain for "common sense".
2. I called in to the show early in your interview to make the comment that when Ross asked you if you'd found any more than the 8 cases, how would you, or anyone, know? How do we know how much more information hasn't been divulged?
I was going to draw comparisons to my case, where it took 4 years to get documents whose very existence had been denied all that time. And even after those documents were produced (in something like a dozen installments, with each installment being accompanied by the statement that "that's everything now") it was apparent there were yet more documents that looked like they would be smoking guns, but the trial judge (in the 2001 trial) specifically described those remaining documents not produced as "miscellaneous" and that "reasonable disclosure had been made" and wouldn't order King County to produce any more - I'd obtained all I was going to.
How do we know what more you haven't received? Answer: we don't - and given King County's pattern and practice, there probably is more. There certainly is a low level of confidence in my mind as to whether anywhere near all the documents anyone ever requests of King County get produced - whether because of their sheer incompetence - which has been their defense since 2001 in my case - or conscious intent.
So did I get on? No, I was on hold right up until 9:58 and then told they'd run out of time for that segment. This is now probably the 6th time this has happened to me when I've called the Dave Ross show in the past two years - versus earlier times when I would routinely get on.

Because the host can read on his PC screen a brief description (usually written by a liberal screener)he can pick and choose those callers, and their opinions he wants to put on the air.
When I call, I don't tell them what I am actually going to say. Instead I tell them some thing that I think they want to hear.
My success rate in getting on the air is pretty good and it is especially funny to listen to Dave Ross when he has picked a call that he thinks will agree with his view but instead supports exactly the opposite view point.
