(Retired) State Deputy Director of Elections John Pearson is on the stand. The feed is crapping out.

Pearson will return as rebuttal witness later. Recess for the day. Resume tomorrow at 9am.

4. Is it just me or did we see another huge "own goal" with this witness? I was only listening with one ear, but I'm pretty sure when she asked him if errors occur in every election, he proceeded to ramble on (poor Dems can't get their witnesses to stop talking in time it seems) and specifically mentioned COURTS ORDERING NEW ELECTIONS in such cases..???

5. Pearson was a witness for Pierce County in CLEAN's election law case back in 2000. He wanted to present himself as a election law expert when he is neither a lawyer or an expert. He came off like a stooge at trial resulting in a bench verdict that Pierce County had, indeed and despite the spin put on by Pearson for those who run the elections, violated state election laws.
How about Nick Handy? Talk about stooges. Recall he worked with Gregoire in the AGO, went in-house as deputy lands commission for his client (Brian Boyle) then ran for that office and lost. He then got hired as Executive Director for the Port of Olympia where he spent millions buying cranes from New Orleans which now serve as nesting cites and left under a cloud after promising that his pay increases would not be counted toward his retirement when, alas, they were. His response to the Port Commissioners and taxpayers was basically, "sorry, suckers." Then his buddy Smiling Sam Reed appoints him director of elections ... a job he has zippo qualifications for other than being part of the ruling class. The R's appear to have nailed him regarding his bias in favor of the D's. He, like Reed, is a D at heart.

7. Thanks Mr. Cynical ... Nick illustrates the fact that labels make no real difference once you're a member of the political elite/class. Nick ran as an R. His spouse is a liberal superior court judge. Nick is an opportunist seeking higher office and, I'll bet, interested in the SOS job.

9. Chris Vance was on KPAM in Portland a few minutes ago. He seems hopeful, but not necessarily confident at this point. The felon votes discovered by the dems make our case a bit more difficult according to Vance.

11. OT from previous post
One method the judge could use to abstain is to determine there is insufficient evidence without asking the felon voters. This would then push it to the SCOW who would then determine secret ballots preclude askign voter intent. Not a likely occurence for the Judge to do but possible. I can just imagine it.

Plaintiff attorney: And did you vote in the 2004 primary?
Felon/Illegal voter: Yes
Plaintiff attorney: Which party do you contribute to?
Felon/Illegal voter: The Democrats
Plaintiff attorney: And which governor candidate did you vote for?
Felon/Illegal voter: Rossi
Judge: Bailiff, please place this man in custody for violations of RCW, illegal voting, and violation of his probation. Schedule a lie detector test. Prepare paperwork for perjury based on the results.
Defense attorney: Your honor, the felon/illegal voter has been granted immunity in order to secure their testimony.
JUdge: Bailiff, please place the Defense attorney in custody for conspiracy to commit perjury, vote tampering, and contempt of court.
