King County Official Policy: Look the other way

The King County Prosecutor's Office issued this legal opinion advising Dean Logan on his responsibilities as elections director regarding voter registration. The punchline is that he has to accept any complete registration form and register the voter. But if he has reason to believe that the information on the form is invalid he "may then forward the matter to the prosecuting attorney's office".

This isn't news to anybody, least of all Dean Logan, who told me as much back in January.

This opinion is lame for two reasons:
1) The applicable statute RCW 29A.08.110 defines complete to include a "complete valid residence address". If Logan thought it was important to defend the integrity of the voting rolls from people who claim residence at bogus residences, he could assert that, say, a private mailbox or storage locker is not a valid residence. The burden would then be on the mailbox voter to prove that he/she actually resides in a shoebox sized cell.

2) More importantly, the legal opinion overlooks RCW 29A.84.010, which states that

1) A county auditor who suspects a person of fraudulent voter registration ... shall transmit his or her suspicions and observations without delay to the canvassing board.
So it seems that the official position of King County is to ignore the requirement to report suspicious registrations, never mind bother to look for them in the first place.

1. "What, you want us to enforce the laws? Never heard of such a thing."

That's why we need election reform; so we never have to feel guilty for not doing what we get paid for.

2. Invites civil disobedience; get 100,000 extra conservative "votes" to show how ridiculous this non-system truly is. They'll change their tune if the fraudulant voter problem hurts them...

3. Another fine example of the democrats talking out of both sides of their mouths. They bemoan that we must preserve our democracy but then turn around and ignore the problems that are threatening it.

4. Well, it seems there's one interpretation of laws for the proletariat, and another way of looking at them for the bougoise.

5. All it requires to win an election is to have somedumbsumofabitch who is too lazy and stupid to do his job and victory is assured. I guess all you people in Washington State have to be grateful for the quality of the employees in your civil service. Nothing like this could come to pass.

6. Everything that was done was done as part of a systematic and deliberate effort to allow those with an inclination to engage in extralegal activity every opportunity to do so while providing a shield of plausible deniability for those responsible for corrupting the process to escape behind.

7. It looks like I can fill out a few thousand registrations in King County using any real address I choose, make up a name, date-of-birth, and sign the registration. Then I can vote thousands of times. I can just see myself going to the polling site and signing the book. That's me...so is that one... and all these on this page...and the next twenty pages. As long as the registration form is filled out completely, we're ok. None of this is checked for validity by anyone? Egads!!!!

With a rigged election system, you can't even elect people to fix the election system. The incumbents like it just the way it is.

9. This jibes well with Huennekens admission that he didn't do much to investigate the reports of provisionals being improperly fed into the accuvote.

Look the other way, it's no big deal, it's just a few votes in a big county. They were giving it their best, lots of work to do in a short time, yada, yada. Cry me a river.

Good enough for government work.

10. You only want to make voting more inconvenient so that you collect more of your people(who WILL negotiate the process), but you're right about the Dems. Many of them will say, "It's 4:20 and I couldn't be bothered."

Too bad for us! But I can't blame anyone but other Dems. for that.

11. Headlice Loosey,

By 'more of your people', do you mean more intelligent people who can read the rules, follow the rules, and respect the rule of law?

I thought that's what you meant! Maybe for once you're correct.

I picture her with flaming red hair, recycling everything, vegetarian, member of E.L.F., A.L.F., PAWS, Sierra Club, with a rape whistle around her pale neck, mad at everything, especially men, no bra, aaahh...I have to stop this....

You just dont want the truth, or to live with it. So go on hating and hating and hating and hating...

13. Headless, don't tell anyone else what they want, because you don't know.

We want fair elections, and we don't trust our fellow citizens to keep elections fair based on the "honor system."

Anyone who says to me that we can have it both ways is a liar or a fool.

14. Headless,
Do I understand you that the current system of voting, checking, administration and management, vote counting and tallying votes is 'just fine with you'? Does not the problems with the past Washington State election in 2004 disturb you? Do you think this was an honest and fair election? Does an honest election count mean little to you? I really would like to know...

15. The lawyers wired–in this means to capriciousness. Essentially this statute says – nobody is responsible – therefore it’s not a problem.
Unfortunately, things will not improve until the liberals have irretrievably broken everything. That’s what happens when the end justifies the means.

16. The voting process is easy enough for a fourth grader in the Public Indoctrina...Education system now. There is no reason to make it so that a four year old can vote unless the Dumbocrapies are too stupid, lazy and/or belligerent to follow the existing rules.

The example to the sheep in the Dumbocrapies party is to follow the Dumbocommie Leaders by ignoring all the laws and just doing what they want and then arguing with whoever calls them on their selfish and criminal behaviour.

Not that I have an opinion mind you, subjective or not.

17. Stefan:

The more you expose, the more rancid the situation becomes.

There is no question the battle has been joined. The opening statements and actions by the establishment merely tell you what side they are on. In fact, I now believe there is a distinct possibility that the courts will rule against Rossi in spite of what the laws say.

While this may be cause for celebration on the left, it would energize the right as nothing else could. It would mean the courts (as well as the legislature) have become corrupted.....a situation that would be plain for all to see.

It causes me to wonder how things got so far off track.

Excellent post, this will be a turning point in our history one way or the other to be sure.

21. Why so surprised? A search of anagrams generated by the words CHRISTINE GREGOIRE returns HERETICS IGNORE RIG and the phrase ENERGETIC RIG, OH SIR.

Posted by: Steven O'Dell on May 3, 2005 01:58 PM
22. A n anagram search of Dean Logan returns NO-NAG LEAD, but he should have said, "NO DEAL, NAG".

An input of GOVERNOR GREGOIRE returns VEERING ERROR, GO, GO!

GOVERNOR ROSSI returns OR SO ROVE GRINS.
GOVERNOR OWEN returns WE NO GOVERNOR.

One of my personal faves is DEMOCRATIC which returns COMEDIC ART or COMEDIC RAT or COMIC RATED (reference to Air America?), whichever you prefer.

And DEMOCRATIC PARTY returns the phrases TRACED TO PRIMARY (Bingo! Direct hit!), DEMOCRACY PIT ART (our olympic majority) or PRIMACY COED TART (our new Governator)and PRIMARY CODE TACT (hah!) ATROCITY CRAMP ED works, too. DOC MIRE AT (sounds like an email address....), CACTI ROD 'EM (a passing reference to their concern for their constituents), CREMATORY DIP ACT ( the shape of things to come? Go, Judge!)

DEMOCRACY returns CREAMY COD, DECOY CRAM and COMEDY CAR (the new gas tax is sure to help....).

Feel free to contribute.

25. Headless,

While I know that your main purpose here is to troll for flamers I hope that you can answer a straight forward question.

Can you honestly say that had the circumstances been exactly the same (mystery votes, sloppy accounting, etc.) but the outcome reversed (two machine counts for your candidate with a final hand count reversing the previous two) and Rossi now occupying the governors office that you would not be doing exactly what we are and demanding an investigation????

I think not....
